Cliff Dilloway has pursued a business career at senior levels with strong technical leanings. A wide variety of experience including shipping, stock exchange, clothing and glass manufacture led to him qualifying as a Chartered Management Accountant. Turning to computers he qualified as a Chartered Engineer in the field of Information Systems Engineering when that degree became available. On the way he became an FCIArb and is a CEDR Accredited Mediator as well as on the Register of Mediators of The Academy of Experts. Some of his work has been in the United States, New Zealand, Egypt and Europe. In 1988 he visited China, Hong Kong and Japan as a member of a Computer Law Delegation.

He has also been appointed to determine matters as an expert on a number of occasions. Disputes in which he has been involved have related to copyright, contract and information systems. Evidence has also been given on behalf of both the Prosecution and the Defence in criminal matters. Twenty or more times he has been in the witness box as an Expert Witness without ever feeling uncomfortable or stressed.

What Cliff Dilloway does do is to handle disputes in an appropriate way to suit the wishes of the parties. He is not a lawyer or a judge and knows not to try to be. Typically he will produce an "Arbitrator's Report to the parties" that sets out evidence he has identified so that it may be challenged and controverted but which contains no conclusions. Issues are thus identified and a settlement may evolve. Many times he has embodied such cost and time saving procedures in consent directions orders.

As an arbitrator Cliff Dilloway is Section 33 competent. This is the section of the Arbitration Act 1996 that puts a proactive role on arbitrators to "adopt procedures suitable to the circumstances of the particular case, avoiding unnecessary delay or expense, so as to provide a fair means for the resolution of the matters falling to be determined". While other arbitrators appear to be waiting to see what happens under the Arbitration Act 1996 Cliff Dilloway has prepared materials that appear on this website as a starting point. Nevertheless he will learn from experience as parties take advantage of their new freedoms under the Act.

       Career

• Progressively until the end of 1975 Cliff Dilloway was employed in increasingly senior positions in a wide variety of industries. After 14 years at the Ford Motor Company he left as Computer Centre Manager for a management consultancy where his final appointment was as Director and General Manager of their software house. Not all this employment was computer related. Financial services industry experience is significant.
  
• From 1976 until 1980 consultancy work was undertaken, mainly carry-over from the last employment. The turn to legal matters came in 1980 and dispute resolution became a new career. Naturally, with a technical background much of the work has been so oriented. However, the most appropriate appellation is "businessman".
  
• The disputes where assistance has been given as an expert witness have ranged from liability following a break in employment, fire losses, copyright and intellectual property disputes, phantom withdrawals from ATMs, maintenance and professional indemnity liabilities as well as the more usual contract and specification disputes. In the last 3 years there have been about 15 cases involving criminal prosecutions.

• A deliberate choice has been taken in 1997 to concentrate on appointments as arbitrator under the Arbitration Act 1996. As a progressive Registered Arbitrator with fifteen appointments behind him there is new ground to be explored. The website material is his own contribution to the development of arbitration "avoiding unnecessary delay or expense".

• As a CEDR accredited Mediator with a pupillage and two mediation type cases behind him Cliff Dilloway has demonstrated his ability to bring people together. A deep and up to date familiarity with business and computer law and practice is the basis for bringing out innovative solutions to intractable disputes.

• For those that seek the best out of mediation but require dispute resolution in any event there is a precedent for a Med/Arb agreement on the website. Med/Arb is not a favoured solution in the dispute resolution community but Cliff Dilloway is used to hearing "I didn't think you could do it" after breaking new ground in a rapidly changing world.
